Public & Products Liability Policy

The general Public and Products Liability policy will be placed with our selected Syndicate at Lloyd’s of London using our Cover Holder status or alternatively as an open market placement. The business that we focus on is business that is difficult to place in the local market or has complex risks that require specialised treatment by an insurer who understands the liability exposures. Lloyd’s offers authorised security and the knowledge and tradition that have made it the most well known insurance market in the world.

Labour Force Professional Liability Policy

The Labour Force Professional Liability Policy was developed to cater for a growing need in the Australian insurance market. This policy is recognised as the industry leader and is the only “complete” liability cover on offer tailored for the labour hire, recruitment, group training and related industry participants. Lawsons will be managing the distribution of this package and provide the value added service for it as an individually underwritten, tailored and “complete” professional liability package.

The package automatically includes the following components;

  • Public and Products Liability
  • Professional Indemnity
  • Directors and Officers Liability
  • Fidelity ($250,000)
  • Representation Costs at Enquiries ($250,000)
  • Statutory Fines and Penalties ($250,000)

You are also offered an option to include Employment Practices Liability.
Key components of the cover include;

Public and Products Liability

  • Includes contractors as an insured entity.
  • Does not have any professional exclusion relating to property damage or personal injury in relation to advice which is not given for a fee.
  • Includes some cover for registered vehicles being driven by on hired workers.
  • Includes liability for damage to goods being transported.

Professional Indemnity

  • Includes single Director “Pty Ltd” contractors as insured entity.
  • Includes vicarious liability for “on hired” professionals.
  • Moves property damage and personal injury matters to liability section, thus avoiding possible “gaps” in cover between insurers.

By wrapping this suite of covers together, without any pre-condition or requirement to enter into “uncertain” transfer of liability, via contractual indemnities, this product provides the broadest cover available for labour industry participants, at a very competitive price.

Host Employer Liability Policy (HELP)

The need has arisen from the increasing claims being made by Hosts under their conventional broad form public and products liability policy as a result of actions by Third Party Workers (or more and more commonly subrogated actions). In the event that any direct employee of a labour hire company or contractor is injured whilst carrying out work duties, they are entitled to the statutory benefits of the relevant workers compensation legislation that exists in each state or territory in which they are employed.

“Injured” Third Party Workers can seek to claim damages or costs from the Host Employer as a result of alleged negligence by the host that resulted in them suffering an injury. Alternatively, workers compensation insurers and Government Workcover agencies are also exercising their rights of subrogation to recover the costs of workers compensation from Host Employers.

HELP provides a simple remedy to this dilemma by providing a separate insurance policy, which allows the exposure to be identified, understood, quantified and managed effectively.
